TERMS AND CONDITIONS

Article 1 : AGREEMENT

These general terms and conditions of purchase (GTC) apply to all sales concluded between customer buyers on the monwhisky.fr website and SAS MARLIM, a company with capital of 274,408 euros whose head office is located at 17 Rue Fulton 87280 LIMOGES France, registered with RCS LIMOGES B 350 041 984
Our T & Cs are accessible at any time on the site, and customers declare that they have read  and agreed to them before placing any order.

Article 2 : ORDERS

The customer selects the products he wishes to order on the website, and monwhisky.fr agrees to accept orders made, within the limit of available stocks.
If, however, the products ordered are unavailable, our company agrees to notify you by email, and will indicate the delivery delay. The customer will also have the option of canceling his order.

We reserve the right to cancel any order that does not meet our criteria expressed in these T & Cs or that we consider questionable.

In addition, for professional customers and in the event of rejection of the order by SAS MARLIM, we reserve the right to carry out certain verifications, in particular by obtaining legal information available on the customer, and to request payment certified by the bank.

Article 3 : PRICE

The prices displayed are in euros, all French taxes included. They do not include delivery costs which vary according to location and the number of products ordered. Shipping costs are available on the site.
Promotional operations, gift cards, discount codes etc.. are non cumulative, and are limited to one per household, per transaction.

Article 4 : DELIVERY

Deliveries in mainland France are made through a courier of our choice and to the address indicated by the customer.

In the event the products are returned to monwhisky.fr, for the following reasons, incomplete address or false address, monwhisky.fr will guarantee to contact the customer to propose a reshipment, after payment of the new delivery costs, or will reimburse the order, after deduction of the original delivery costs.

Deliveries in the European Union are made under the same conditions as those made in mainland France. The list of European countries eligible for delivery can be found in the annexe: delivery conditions.

Our products travel at the risk and peril of the recipient. It is their responsibility to check the condition of the products upon delivery. In the event of damage or missing items (verify delivery notice) the recipient must make findings known to monwhisky.fr.

In the event of breakage, the recipient must refuse delivery of the package, and monwhisky.fr, after receiving information from its courier, will send a replacement.

In all cases, the customer should notify MARLIM by registered letter with acknowledgment of receipt, and by email to hello@monwhisky.fr within 48 hours of delivery of the package.

After the order processing period, the products will be delivered within 10 days and must not exceed a maximum delay of 30 days, except in cases of force majeure or exceptional circumstances, which release monwhisky.fr from its obligations (war, riot, fire, events of all kinds disrupting our supplies or transport conditions, strike or lockout).

Article 5 : PAYMENT

Payment for purchases is made online. The custimer guarantees that he has the necessery authorizations for the payment method he has chosen on the website. Payment by card benefits from a secure line and regulatory provisions in the event of fraudulent use. The order becomes final when payment is confirmed.
For payments by bank transfer, all information is provided at the end of the ordering process. The preparation of the order will be triggered when the transfer is received in our bank account.

SAS MARLIM remains the owner of the goods until full payment is received from the customer. (Law n°80335 du 12.05.1980).

Article 6 : RIGHT OF WITHDRAWAL

The non-professional consumer has, in accordance with the provisions of Article L121-21 of the Consumer Code, a withdrawal period of 14 working days from the delivery of the products to terminate the contract by email to hello @ monwhisky .Fr. The products must be returned to us for exchange or refund, provided the products are returned in their original packaging and in perfect condition. Damaged, soiled or incomplete items will not be accepted. If the right of withdrawal is exercised within the aforementioned period, only the price of the product (s) purchased and the delivery costs will be reimbursed. The refund will be made within thirty days of receipt of the returned goods. Return costs will be the sole responsibility of the customer.

Returns must be accompanied by the original purchase invoice, as well as the withdrawal letter (downloadable in format pdf * below)

Article 7 : PRODUCT GUARANTEE

The product warranty conditions are specified on each product sheet. The warranty runs from the date of delivery and is subject to normal use of the products.
Our products benefit from the applicable legal guarantee, in particular that concerning hidden defects, in accordance with Articles 1625 et seq. Of the Civil Code.

Article 8 : INTELLECTUAL PROPERTY

All the elements on the website (logos, graphics, photos, animations, sounds, texts) are the sole property of the company SAS MARLIM, to the exclusion of elements belonging to a partner of the company SAS MARLIM.

Article 9 : RESPONSABILITY

The information available on our site is not inclusive, and the MARLIM company strives to ensure its accuracy and updating to the best of its ability. MARLIM therefore reserves the right to modify this information at any time. The information contained on our site is the property of the MARLIM, and subject to existing laws on the protection of copyright. Copies of information on our site are for personal use. Any other use is strictly prohibited. Consequently, MARLIM declines all responsibility for the use of its information, and more generally for any direct or indirect damage caused by its use.

We decline all responsibility for the hypertext links on our site directing users to other websites. Individuals or legal entities who wish to create a hypertext link on our site must request authorization from MALIM.

Alcohol abuse is dangerous for your health, consume in moderation. The customer agrees to be 18 years old by ticking the box dedicated to this purpose when filling out the order form. 

Article 10 : PROTECTION AND USE OF PERSONAL DATA

Your privacy and the protection of your personal data are important to SAS MARLIM. On this site, you may be asked to complete a registration form to subscribe to certain services or to receive additional information. In order to manage your relationship with our company, better serve you and personalize your experience and interaction with us, we may be required to collect, export and use your personal data. In any case, this collection is carried out on notice and with your consent, and in accordance with the applicable data protection regulations.

Your personal data may be collected in the following cases:

  • orders, activations and registrations of products or services
  • profile creation and verification of the user in the context of online services
  • requests for information or complaints
  • subscriptions to marketing services, support or newsletters
  • participation in contests or surveys
  • job applications
  • registration for events
  • visiting or browsing the MARLIM websites

You are likely to provide us with the following types of personal data:

  • your personal and professional contact details, including your name, address, telephone number and email address.
  • in some cases, your contact details may be sent to SAS MARLIM by a designated entity within your activity or company (such as a member of your purchasing department).
  • financial information, such as your credit / debit card number or other billing information.
  • other unique information: usernames, passwords, product features, preferred products and services, preferred modes of communication, training and professional experience and professional interests.
  • geolocation data, including your IP address or physical location when you request geolocation-based services.

Each of the fields of the corresponding form indicates whether the requested information is mandatory or optional. If the user does not complete the fields that are designated as "mandatory", this will result in a refusal to subscribe to a service or newsletter, or a request for information.

How do we use your data?

We use your data to process orders, to provide you with certain services and to provide you with the information offered on our website which you may also request. Otherwise, we only use this data with your permission. We do not sell your personal data to third parties and we only make it available to third parties involved in the fulfillment of your order.

Rights relating to your personal data

Your personal information is collected and processed by SAS MARLIM, whose head office is located: 17 Rue Fulton Z.I. Nord, 87280 LIMOGES. To this end, your personal data may be transferred between the entities of the Group and / or its partners.

In accordance with Law No. 78-17 of January 6, 1978 and General Data Protection Regulation RGPD, you have the right to access, rectify/erase, limit the processing of your data, oppose the processing for legitimate reasons, of data portability as well as the right to define directives relating to the fate of his data after death.

These rights can be exercised directly with the Legal Department - DPO RUE ANDRÉ ET GUY PICOTY - BP1 23300 LA SOUTERRAINE, indicating the name of our company as well as your surname, first name, address, email and if possible the customer reference in order to speed up the request. In the event of an unsuccessful complaint, the CNIL is contactable.

Article 11 : APPLICABLE LAW

Our general conditions of sale are subject to French law and only fall within the jurisdiction of the French courts.
